June 23, 1983 19 EXECUTIVE COUNCIL BILL 06 UNIVERSITY OF COLORADO STUDENT UNION Sponsored By: Representative-at-Large: Bill Tucker A BILL BILL SUMMARY Amends the UCSU Election Code BE IT ENACTED by the Executive Council of the University of Colorado Student Union, THAT: SECTION 1: A. Section 15.3 of the UCSU Election Code shall be amended to read: "15.3 Each polling station shall have at least one voting machine or ballot box capable of being securely locked and tamperproof. Only the Appellate Court Justice(s) or bonded security agent(s) may possess keys to these locks." B. C. Section 15.6 of the UCSU Election Code shall be amended to D. Section 15.7 of the UCSU Election Code shall be amended to read: "15.7 Ballot boxes shall never be opened du r ing the days of Page -219ECB-6 voting, after once having been sealed in the presence of the Election Commissioner or authorized assistant Election Commissioner each in the resence of at least two 2 Appellate Court Justices, for any reason. Ballot boxes shall remain under lock and shall have a metal seal applied in addition to the locka:t"the opening of each polling station each day. This seal shall be of the unbreakable variety and shall have to be cut to open the ballot box(es). (The seal shall be strong enough to keep the ballot box(es) locked and secure without a lock). The metal seal shall be of a unique variety unobtainable b the eneral ublic and shall be placed on the ballot box es by the Appellate Court Justice(s) at the o enin of each ollin station. The Appellate Court Justice s shall retain custody of any unused seals in a secure place. ((Type the rest of the section as it exists, without the paranthetical material after my last sentence. The next sentence should read: "The seals used shall not be readily ••• ")) -E. Section 15.8 of the UCSU Election Code shall be amended to read: "15.8 At least one member of the Election Commission shall be present at all times from opening to closing at each polling station each day to ensure security and fairness of the voting procedures. In addition the Election Commissioner or authorized assistant Election Commissioner either one accom anied b at least two 2 Appellate Court Justices, must be present at the opening and closing of each polling station each day." F. Section 16.8 of the UCSU Election Code shall be amended to read: "16.8 All printed ballots shall be kept under lock and key by bonded security agent(s) until the days of the election. Onl the Election Commissioner accompanied by two 2 Justices of the Appellate Court rna have access to these ballots rior to the election; to wit, three 3 signatures shall be required to release the ballots to the Election Commissioner. At the end of each polling day, all cast, uncast, multilated, or otherwise defaced, unreadable, or disqualified ballots shall be turned over to a bonded security firm for storage until the opening of the next day of voting, or in the case of the second day, until the ballots are counted." G. Section 16.10 of the UCSU Election Code shall be amended to read: "16.10 Each polling station shall have an enlarged version of a ballot posted conspicuously, so that all Page -319ECB-6 voters can see it plainly, at the polling station. Section 17.4 of the UCSU Election Code shall be amended to read: "17.4 One ballot shall then be validated with the unique validation stamp of that particular election and then the pollisitter sha ll obscure the names of candidates that were disqualified or voluntarily withdrew after the printing of the ballots. These things having been done, the pollsitter then hands the ballot, together with all printed instructions, to the voter. The member of the Election Commission presei1t5hall ensure that only those candidates who have been disqualified or voluntarily withdrew are obscured from the ballots." I. Section 17.6 of the UCSU Election Code shall be amended to read: "17 .6 A voter may request a new ballot for any reason, upon returning the first one for exchange. The first ballot shall then immediately be invalidated ~ marking a large "X" on the ballot with an indelible marker. The invalidated ballot shall not be destroyed or disgarded, but stored to ensure a proper count at the close of the polling station." J. Section 17.7 of the UCSU Election Code shall be amended to read: "17.7 If the voter abandons the ballot, it shall be collected by a commission member or pollsitter and invalidated and secured in a manner such as described in Section 17 .6." K. Section 17.10 of the UCSU Election Code shall be amended to read: "17 .10 Disqualified or voluntarily withdrawn candidates may not appear on the ballot. in the case of disqualification or withdrawal after the ballots have been printed, those candidates names shall be obscured as per Section 17.4." L. Section 18.2 of the UCSU Election Code shall be amended to read: "18.2 If ballots are hand-tabulated, tabulation shall be performed in Election Committee and Appellate Court view even if tabulation has been contracted to a bonded security firm." M. Section 18.5 of the UCSU Election Code shall be amended to read: "18.5 Ballot validity shall be determined only by the • Page -4l9ECB-6 Election Commissioner." N. Section 18.6 of the UCSU Election Code shall be amended to read: "18.6 A ballot shall be invalidated for the following reasons, but not limited to these reasons: a) lack of a unique, registered ballot validation stamp or the presence of a validation stamp other than the official, registered stamp of the election. b) illegibility c) physically incapable of being tabulated." SECTION 2: The Executive Council and UCSU shall contact and obtain the services of the Election Commission of Boulder County to administer the Falll983 and Spring 1984 UCSU elections. The Boulder County Election Commission shall have full purvue over the election and the new election commissioner of UCSU shall work with the Boulder County Election Commission before, during, and after the Falll983 and Spring 1984 Elections. SECTION 3: The next Election Commissioner shall be appointed for a period of one year, to insure continuity of the elections in the Fall of 1983 and Spring of 1984. The duties of the Election Commissioner shall include, but not be limited to, working with the Boulder County Election Commission before, during and after the Fall 1983 and Spring 1984 UCSU Elections and preparing an Election Commissioner's Handbook detailing all the various steps of the election. In addition, the next ElectionCommissioner must have had UCSU Election Commission experience either as an Election Commissioner or Assistant Election Commissioner.
