The timeline for putting a constitutional amendment on the ballot was exceeded with the passage of 62LCB#5 and the University of Colorado Student Union Appellate Court ruled that the amendment should be taken off of the ballot for the Spring, 2005 election. The court did find however, that the UCSU is in violation of a number of court rulings regarding the allocation of student fees to student groups at the University of Colorado at Boulder. The Legislative Council is charged with creating a process by which allocations of student fees may be made in a viewpoint neutral manner.
Bill Summary
This bill sets forth the viewpoint
neutral funding process as outlined in 62LCB#5 so that the UCSU is not in
conflict with Article VII, Section B of the UCSU Constitution which states, “All student fee policy and expenditures shall comply
with Federal and State laws, as well as university policy as set forth by the
Board of Regents.” This legislation
alleviates the constitutional crisis created by the provisions within the Constitution
that are in conflict.
THEREFORE BE IT ENACTED by the
Legislative Council of the University of Colorado Student Union, THAT,
Section 1: The
process and timelines as set forth in 62LCB#5 shall be utilized in the creation
of the viewpoint neutral funding process.
Section 2: This bill takes effect upon passage by the
Legislative Council and upon obtaining the signatures of the Tri-Executives.
