A Resolution Concerning the UCSU Appellate Court.


WHEREAS, the animating principles of the University of Colorado Student Union’s Constitution demand an effective and robust tripartite form of government;

WHEREAS, the University of Colorado Student Union Appellate Court is a vital and coequal branch of the student government;

WHEREAS, a number of conflicts have arisen that ought to have been resolved by the Appellate Court;

WHEREAS, the Appellate Court is vital in ensuring that the fidelity of the Constitution is protected and that all voices are heard;

WHEREAS, the Appellate Court has only three current members and is therefore prohibited by the Constitution to meet to resolve disputes;

WHEREAS; the Tri-Executives are charged by the Constitution to appoint members of the Court when vacancies may occur;

Whereas; the Tri-Executives have not yet filled these vacancies nor have they informed the Legislative Council of any intent to do so;

THEREFORE BE IT RESOLVED by the Legislative Council of the University of Colorado Student Union that the Constitutional crisis created by an inoperable Appellate Court ought to be addressed immediately by the Tri-Executives. Four qualified justices ought to be appointed as soon as practically possible.
