Council of Colleges & Schools & Representative Council Bylaws

Bill History

Currently there is no provision within the Legislative Council bylaws that governs how the Council of Colleges and Schools and Representative Council are to amend their individual bylaws. The Council of Colleges & Schools bylaws contain no provision for their modification. The Representative Council bylaws indicate that Representative Council may amend the bylaws without legislative council approval. Article V of the UCSU Constitution provides that each UCSU organization has the authority to adopt bylaws. While it is very likely that each council has the authority to modify their own bylaws, the lack of a provision within the Legislative Council bylaws leads to unnecessary confusion.

 

This bill would amend the Legislative Council bylaws to explicitly authorize the Council of Colleges & Schools and the Representative Council to amend their own bylaws.      

                                                                                                                                               

Bill Summary

            This bill amends the Legislative Council Bylaws to authorize the Council of Colleges & Schools and the Representative Council to amend their bylaws without Legislative Council approval.

THEREFORE BE IT ENACTED, by the Legislative Council of the University of Colorado Student Union, THAT:

 

Section 1:  Section 7 shall be added to Article III, B of the Legislative Council bylaws. This section shall provide, “The Representative Council may adopt, amend, and otherwise provide for its own bylaws. These bylaws must conform to, and are subsidiary to the Legislative Council bylaws.”

 

Section 2: Section 6 shall be added to Article III, C of the Legislative Council bylaws. This section shall provide, “The Council of Colleges and Schools may adopt, amend, and otherwise provide for its own bylaws. These bylaws must conform to, and are subsidiary to the Legislative Council bylaws.”

 

Section 3: Pursuant to Article III, Section 7(d) of the Legislative Council bylaws, these amendments must be introduced one week prior to a vote on their approval; only one vote of approval is necessary for passage. Pursuant to Article XI of the Legislative Council bylaws, this amendment must be approved by 2/3 of the entire Legislative Council (12 votes).
